Delhi High Court recently granted universities in India the right to deny admission to students who fail to present proper documents at the time of counselling. The rule applies for all those students who have cleared the entrance examination with a valid rank.

The judgment came after a law aspirant, Bhim Shankar Thakur, filed a petition against Delhi University (DU) for denying him admission to LLB course for being unable to produce original graduation certificate. Thakur had secured 767 rank in OBC category and was called for counselling on August 22, 2022.

Thakur had graduated in 2012 from a university in Meerut but collected his graduation certificate on September 8, 2022 only after he was denied admission by DU. He submitted the certificate IN DU after the counselling procedure had finished resulting in denial of admission.

The verdict was passed by Justice Sanjeev Sachdeva, who said that the action of DU cannot be put on fault as Thakur failed to appear for the counselling with original documents required and produced them at a subsequent date. 

As per Thakur’s advocate, he was unable to present any proof that the university in Meerut had not issued the graduation certificate before the DU counselling.

Dismissing the argument of Thakur’s advocate, Delhi HC stated in its judgment that ‘a degree not collected is not equal to a degree not issued’ by a university, making it compulsory for candidates to produce all original documents during counselling.
