Courts Cannot Review NEET 2016 Answer Keys, Says Delhi HC

NEET 2022 was recently conducted when petitions against CBSE (and other expert) answer keys for the questions in the NEET were filed. The Delhi High Court however rejected these petitions saying that the courts cannot review answer keys prepared by subject experts. Justice Sanjeev Sachdeva took this decision, claiming that independent experts prepare the answer keys and one cannot take over the task of correcting it.

Sagar Sanjeev Dua, who challenged the Central Board of Secondary Education (CBSE) to five questions of NEET 2022, filed the petition. The court has dismissed the plea, noted that the information bulletin for NEET 2022 stipulated that there was no provision for rejecting and re-evaluating the answer keys. The Justice stated that the court, in exercise of powers under Article 226 of the Constitution, cannot take over the task of correcting the answer key framed by an independent subject expert. In addition to this, the examination paper has questions from the Physics, Chemistry and Biology and to examine whether the answers are correct or not, would be beyond the competence of a court, which is not an expert in the subject.
